2. Counter-Notification

If you believe that the material removed due to a DMCA takedown notice is not infringing, or that you have the right to use the material (for example, under fair use or with permission from the copyright owner), you may file a counter-notification. Your counter-notification must include:

  • Identification of the removed material: Provide details of the content that has been removed and where it appeared on the website before it was taken down.
  • Your statement of good faith: A statement that you believe, under penalty of perjury, that the content was removed as a result of a mistake or misidentification.
  • Your consent: A statement that you consent to the jurisdiction of the federal court in your district and that you will accept service of process from the person who provided the original DMCA notice.
  • Signature: Your physical or electronic signature.

3. Actions After Filing

Upon receiving a valid DMCA takedown notice, we will remove or disable access to the infringing content and notify the user responsible for the content. If we receive a counter-notification, we may restore the content unless the original complainant files a lawsuit within 10 business days.
